What is Service of Process?
Service of Process
is when legal documents such as summons, complaints, subpoenas, writs
and other court documents are delivered to the individual to whom the
legal document is directed. Service of Process must be served by an
individual who is not a party to the case.
Types
of Papers We Serve
Small Claims, Landlord Notice, Civil Subpoenas,
Divorce, Evictions, Restraining order, Notice of Motion, Summons and Complaint (or petition), Order to show cause,
Other non-enforcement process not listed.
What does a Process Server do?
As
legal process servers we deliver (or serve) legal documents to a
defendant or an individual involved in a court case. We must serve the documents in accordance with the legislation in the area
of service.
This may mean handing the documents to the defendant
personally or sub-serving to someone in the same household or business.
Once the documents are delivered, as process serving agents we must
provide proof that the papers were served. This is done through a
document call an Affidavit of Service, also called a Proof of Service,
which must be notarized and given to the party who requested service.
As Process
servers we will file your papers with the courts. Other services we offer are document
retrieval and various types of investigations such as people location research.
Service
Of Process Rates
Rates start at $50 for a simple personal serve which include 3 attempts of personal service on three different days and at different times including before 8 AM and after 5 PM. We
serve papers 7 days a week. Back country process serving
and next day services are charged at a higher rate.
My
husband and I work as a team to make sure the papers
are served legally and quickly. We take notes on each
serve for future court references. We are both
Experienced Registered Process Servers with the
State of California. We are both bonded as required
by law.
